In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (General Data Protection Regulation) ("Regulation"), and pursuant to Act No. 18/2018 Coll. on the Protection of Personal Data ("Act"),

(hereinafter also referred to as "Elveron", "Autotrendix", the "Controller", or the "Seller").

A Buyer is defined as any natural person, natural person - entrepreneur, or legal entity interested in entering into a purchase agreement with the Seller, or who has entered into such an agreement (hereinafter "Buyer" or "Customer").

According to the Act, the Controller is any entity that alone or jointly with others determines the purpose and means of processing personal data and processes it on its own behalf. For the purposes of the website www.autotrendix.com the Controller is the Seller.

A Data Subject is defined as any natural person whose personal data is being processed. For the purposes of the website www.autotrendix.com, the Data Subject is the Buyer.

This notice informs visitors to the website www.autotrendix.com about the collection and processing of their personal data. It is primarily intended for our customers, business partners (recipients and suppliers), and their employees authorized for communication regarding the delivery of products and services under contractual relationships.

Your personal data is processed solely on the basis of legal grounds provided for in the Regulation or the Act. As the Controller, we are responsible for the protection of your personal data, which we collect or have collected from you in accordance with the Regulation and the Act, within the scope and manner set forth in this statement.

Your personal data will be securely stored and backed up in accordance with our internal security policy and the policies of our processors, for only as long as is specified below.

Access to your personal data will be granted to authorized recipients and persons designated by us who process the data according to our instructions and in accordance with our security policy. As the Controller, we are also required to ensure proper backup of data in compliance with the security requirements of the Regulation and the Act.


Source of Personal Data

Personal data, according to the Act, primarily refers to data relating to an identified or identifiable natural person who can be identified directly or indirectly, particularly on the basis of a general identifier or other identifiers, such as name, surname, ID number, location data, or online identifier.

Your personal data is obtained primarily from you when you voluntarily provide it in connection with a request or inquiry regarding our products. This may occur in person, by phone, in writing by post, electronically, or through our e-shop, based on your specific request.


Categories of Personal Data

The data we typically process regarding customers and business partners, including data about their employees, includes:

  • Identification and contact details: Name, surname, mailing address, phone numbers, email addresses, and for self-employed individuals: business name, business address, company ID and tax ID number.
  • Purchase and discount information: Order details (order number, purchase date, type and quantity of goods, price, delivery and payment method, automated notifications, order status).
  • Banking and transaction information: Credit card number, bank account details, payment records.
  • Contract-generated information: Customer number, document numbers and dates, goods/services details, price, payment and delivery methods, warranty information.
  • Communication records: Details about our mutual correspondence, including date, channel, and message content.
  • Withdrawal and returns: Withdrawal date, refund or return details.
  • Complaints and claims: Complaint date, description, method of handling and resolution.
  • Objections and appeals: Identity and contact details of complainant, reason, and resolution method.
  • Marketing information: Purchase behavior, customer group classification.
  • Product and service reviews.


Necessity of Providing Personal Data

We need certain personal data from you to fulfill our contractual obligations. If this data is not provided, we cannot establish a contractual relationship, as defined in the Slovak Commercial Code. Not providing a phone number or email does not prevent the contract, but it does limit communication. Without an email, we also cannot send electronic invoices, and they will be delivered only by post.

We request ID documentation only from authorized persons collecting goods to verify identity and ensure proper handover of deliveries.

Not providing personal data can significantly hinder or prevent the fulfillment of contracts or effective communication.


Recipients of Personal Data

All your personal data is stored in our internal systems and may be shared with third parties such as:

  • Regulatory and supervisory authorities (e.g., Slovak Trade Inspection, Data Protection Office, Tax Office)
  • Courts and law enforcement authorities upon request or for legitimate interest (e.g., enforcement of claims)
  • Contracted service providers for:

We work with providers such as Google Ireland, Facebook Ireland Ltd., and Shopify International Ltd. to improve user experience. We ensure all processors meet adequate data protection standards.

Purpose and Duration of Personal Data Processing

We collect and process your personal data for the following purposes:


Registration and Operation of the E-Shop

We process your personal data to enable registration and use of our online store. The legal basis for this processing is Article 6(1)(b) of the GDPR – processing necessary to take steps at your request prior to entering into a contract, in accordance with Act No. 22/2004 Coll. on Electronic Commerce.

Your data is processed for as long as your e-shop account remains active. You can delete your account at any time via your user profile.


Purchasing Through the E-Shop, Product Delivery, Complaints Handling, and Insurance Claims

We process your data in order to fulfill contractual obligations related to your order placed via the e-shop. This includes delivering products to you, managing orders, receiving and handing over goods, handling insurance claims, processing complaints and grievances, issuing invoices, storing related documents and records, and facilitating communication between contractual parties.

The legal basis for processing your data for this purpose is Article 6(1)(b) and (c) of the GDPR – performance of a contract and compliance with our legal obligations under Act No. 513/1991 Coll. (Commercial Code).

Providing personal data is a contractual requirement. Without this data, we cannot enter into a contractual relationship.

Your personal data will be processed only as long as necessary to fulfill the specified purposes, but no longer than for the duration of the contractual relationship. After termination, the data will be stored for 10 years to comply with legal obligations, particularly under the Accounting Act.


Performance of Contractual Obligations

We also process personal data to fulfill our contractual obligations or to take pre-contractual steps at your request. This includes preparing and sending price offers, drafting and concluding contracts, managing records of contracts (including amendments), monitoring compliance with obligations, coordinating delivery of goods, resolving insurance claims, handling complaints and grievances, invoicing, and communication related to contract performance.

Legal basis: Article 6(1)(b) and (c) GDPR – performance of contract and compliance with legal obligations, especially under the Commercial Code.

Failure to provide personal data will prevent the formation of a contractual relationship. Once the contract ends, your data will be stored for 10 years in line with legal requirements.


Customer Support via Email

We process the following personal data to provide telephone and email support: name, surname, phone number, email address, and your order number. Data is retained during the product warranty period (2 years from purchase).


Handling Customer Complaints

To address customer complaints, we process: name, surname, details from the complaint, and depending on how the complaint was submitted, also your address, phone number, or email address.

Legal basis: Article 6(1)(b) GDPR – processing is necessary to handle the complaint.


Contests

We process personal data for the purpose of conducting contests via our website and Facebook, including: data from the contestant’s profile and, in case of a winner, their first name, initial of their surname, and alias.

Legal basis: Article 6(1)(b) GDPR – processing necessary for the performance of a contract (contest terms and conditions).


Commercial Information About Products and Promotions

If you give us your consent, we may send you commercial information about products and special promotions via email, SMS, notifications, or other forms of communication. During registration in our e-shop or when placing an order, you can choose whether you wish to receive regular updates about new products and offers. We will only send commercial information to the extent and frequency that is not intrusive. You can adjust the frequency and form of such communication at any time in your user profile.

You may also choose to receive information about products and special offers without registering in the e-shop by entering your email address directly on our website.

The legal basis for processing your personal data for this purpose is Article 6(1)(a) of the GDPR – your explicit consent. You can withdraw your consent at any time by clicking the unsubscribe link in our emails or by sending an email expressing your objection to: info@autotrenix.com. You can also unsubscribe from newsletters at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

If you are already our customer, we consider it our legitimate interest to occasionally inform you about various promotions and especially discounts via SMS or other means. You have the right to opt out of receiving such SMS messages at any time by sending an email to info@autotrenix.com, by adjusting the subscription settings in your account, or as specified directly in the SMS.

The seller may also inform the buyer by email about the status of their order and the availability or unavailability of products. All registered customers may occasionally (a few times per year at most) receive important updates related to the operation of the online store and the use of their user account.

If you object at any time to the processing of your personal data for direct marketing purposes, we will cease processing your data for this purpose.


Exercising the Rights of Data Subjects

It is the legal obligation of the Controller to properly address any requests by data subjects exercising their rights under the GDPR.

Your personal data, when processed for the purpose of fulfilling data subjects’ rights, may be retained for up to 10 years if you choose to exercise your rights.


Enforcing Company Claims

We process the following data to pursue our company’s legal claims: data from contracts with customers and suppliers, data from complaints, data required to file or respond to legal claims, theft records, accounting records, and other data necessary for enforcing claims or protecting the company’s interests.

The purpose of processing such personal data is our legitimate interest, and the legal basis is Article 6(1)(f) of the GDPR. The processing of this data is essential for the company’s legitimate interests, including protection of property and defense against unfounded legal claims.

If we file legal claims against you or initiate legal or administrative proceedings—or if you take legal action against us—your personal data will be processed to prove, assert, or defend legal claims until the final resolution of the matter.

In cases where you fail to fulfill your obligations to our company, cause us damage, or claim rights against us—or if such situations are likely to arise in the future—we may process your personal data for the purpose of debt collection and/or protecting our legal rights and interests (e.g., to assert, defend, or enforce legal claims before a court or consumer dispute resolution body).

Your personal data will be stored for the duration of the statutory limitation period applicable under Slovak law.

Compliance with Legal Obligations

The company processes the personal data listed in points (a) to (m) for the purpose of fulfilling its legal obligations. The legal basis for such processing is Article 6(1)(c) of the GDPR (e.g., obligations arising from the Accounting Act, the Value Added Tax Act, the Income Tax Act, the Consumer Protection Act).

The processing of personal data by the company is necessary in order to comply with legal obligations imposed on it.

For this purpose, we retain your personal data in accordance with the statutory retention periods defined by applicable laws, especially the Accounting Act and the Archives and Registries Act.


Transfer to Third Countries or International Organizations
